Agreement to These Terms

Welcome to Aura Aesthetica. These Terms of Service ("Terms") govern your access to and use of auraaesthetica.com and any related services (collectively, the "Site"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

These Terms apply to all visitors, prospective patients, and current patients who use the Site. If you are using the Site on behalf of another person, you represent that you have the authority to bind that person to these Terms.

Results and Outcomes

All surgical and aesthetic procedures carry inherent risks, and outcomes vary based on individual factors including anatomy, health history, lifestyle, and adherence to pre- and post-operative instructions. Photographs, videos, testimonials, and case studies displayed on this Site represent the experiences and results of specific patients and are not a guarantee, warranty, or prediction of the outcome you may experience.

Before-and-after photos and videos are published with the consent of the patients shown. Individual results vary, and the photos and videos shown should not be interpreted as typical or expected results.

Use of the Site

You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use of the Site. Specifically, you agree not to:

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AURA AESTHETICA, DR. JONATHAN KANEVSKY, OUR AFFILIATES, EMPLOYEES, AGENTS, OR CONTRACTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, OR DAMAGES FOR PERSONAL INJURY, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SITE EXCEED ONE HUNDRED DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU IN FULL.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for medical malpractice arising from clinical care provided in our office, which is governed by separate consent forms and California law.

Indemnification

You agree to indemnify, defend, and hold harmless Aura Aesthetica, Dr. Jonathan Kanevsky, and our affiliates, employees, agents, and contractors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any rights of another party.

Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Site shall be resolved exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of those courts.

Before filing any legal action, you agree to first contact us in writing at the address below and attempt to resolve the dispute informally. We will make a good-faith effort to resolve any concern within thirty (30) days of receiving your written notice.

Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page indicates when the Terms were last revised. Material changes will be reflected by updating that date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.
